No contract renewal for Limbo as Bukalo CEO

THE Labour Court has ruled that the Bukalo Village Council does not have any legal obligation to renew the contract of the council’s chief executive officer, Martin Limbo, for another five years.

On 17 February 2020, the Bukalo Village Council decided not to renew Limbo’s contract that expired on 31 May 2020.

However, Limbo took the matter to the Labour Court where he argued that his performance was never appraised for the duration of his employment contract, as per clause 8.8 of the employment contract, resulting in a breach of contract.

He said the performance appraisal becomes the only yardstick with which to measure the performance of a contract employee, and whether such contract should be renewed or not.

Hence, the council failed to appraise him for the five years of his first term.

However, the ruling arbitrator David Ithana gave on Monday, which was seen by The Namibian, states that the applicant (Limbo) failed to prove that there was a legitimate expectation to renew the long-term contract. He added that Limbo’s contract came to an end by effluxion of time.

“The applicant was served with notice of termination of contract employment,” he stated.
